Terms of Use

Effective: July 2026

These Terms of Use are the agreement between you and Varie Industries for the FitCheck app. Please read them. They explain what you can expect from us, what we expect from you, how subscriptions and purchases work, and the limits of what an AI try-on image can promise. If you do not agree with these terms, please do not use the app.

1Acceptance of these terms

By downloading, installing, or using FitCheck, you agree to these Terms of Use and to our Privacy Policy, which is part of this agreement. If you are using the app on behalf of someone else, you confirm you are allowed to accept these terms for them. If we update these terms, continued use of the app after the update means you accept the revised terms.

2Eligibility

You must be at least 13 years old to use FitCheck. If you are under the age of majority where you live, you may use the app only with the involvement and consent of a parent or legal guardian. By using FitCheck, you confirm that you meet these requirements.

3Your license to use the app

Varie Industries grants you a personal, limited, non-exclusive, non-transferable, revocable license to use FitCheck on Apple devices that you own or control, for your own personal, non-commercial use, in line with these terms and the App Store rules. We keep all rights in the app itself, including its software, design, and branding. You agree not to copy, resell, reverse engineer, or otherwise misuse the app except where the law expressly allows it.

4Subscriptions, free trials, and auto-renewal

FitCheck offers auto-renewing subscriptions. Pricing is shown in the app at the time of purchase and may include the following options:

Weekly subscription at $5.99
Monthly subscription at $19.99
Annual subscription at $59.99

Some subscription options include a 3-day free trial. Here is how the billing works:

Auto-renewal. Subscriptions renew automatically for the same period at the then-current price unless you cancel. Your Apple ID account is charged at confirmation of purchase and again at each renewal.
Free trial conversion. If your plan includes a 3-day free trial, it converts into a paid subscription automatically at the end of the trial unless you cancel at least 24 hours before the trial ends. Any unused portion of a free trial is forfeited when you buy a subscription during the trial period.
Renewal timing. Your subscription renews unless auto-renew is turned off at least 24 hours before the end of the current period.
Managing and canceling. You manage and cancel subscriptions in your Apple ID account settings on your device, under Settings › your name › Subscriptions. Canceling stops the next renewal. It does not retroactively refund the current period. We cannot cancel an Apple subscription for you.
Refunds. Subscription payments are handled by Apple, and refund requests are handled by Apple under its policies. We do not process App Store refunds directly.

5Consumable "Looks" packs

FitCheck also offers a consumable in-app purchase, "Looks" top-up packs, which add a balance of try-on renders to the app.

Please read before buying Looks

Looks packs are consumable and non-refundable. They are consumed as you use them and do not carry the renewal or roll-over behavior of a subscription. A balance of Looks is tied to the App Store account that bought it and cannot be transferred, exchanged for cash, or moved to another account. Once purchased, a Looks pack cannot be returned except where the law requires otherwise.

Looks have no cash value, are not property, and are a license to use a feature of the app. We may adjust the size or price of future Looks packs, but that will not change a balance you have already purchased.

6Acceptable use of photos, likeness, and AI images

FitCheck lets you generate try-on images from a photo of yourself. That power comes with clear responsibilities. By using the app, you agree to all of the following:

You own the rights to what you upload. You must have all necessary rights to any photo you add, including the garment images and the photo of a person.
Only you, or someone who consented. You may add a photo of yourself, or a photo of another person only if that person has clearly consented to being used in the app. Do not add a photo of anyone who has not agreed to it.
No impersonation. You may not use FitCheck to impersonate another person or to make it appear that someone said or did something they did not.
No harmful or unlawful content. You may not create content that is misleading, defamatory, harassing, hateful, sexually explicit, or that exploits or endangers a minor, and you may not use the app for any unlawful purpose.
No deceptive use. You may not present AI try-on images as genuine photographs in a way meant to deceive others.

You are responsible for the content you add and create with FitCheck. If your use of the app breaks these rules, we may limit or end your access, consistent with Apple's platform rules.

7AI output is an approximation

Try-on images in FitCheck are generated by AI and are visual approximations, not exact or guaranteed representations. They are a styling aid, nothing more.

Do not rely on renders for accuracy

An AI try-on image may not accurately show how a garment truly fits, drapes, sizes, or how its color and texture appear in real life. Do not rely on a FitCheck render for any purchasing, sizing, financial, or other important decision. Always confirm details with the actual product and seller. We do not guarantee the accuracy of any generated image.

8Service availability and changes

We work to keep FitCheck available and working, but we do not promise it will always be uninterrupted or error-free. The try-on feature depends on third-party image-processing providers and on your internet connection, and those may be slow or unavailable at times. We may add, change, or remove features, and we may update or discontinue parts of the app.

9Disclaimer of warranties

FitCheck is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, to the fullest extent permitted by law. This includes any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will meet your requirements, that it will be uninterrupted or error-free, or that any AI-generated image will be accurate. You use the app at your own discretion and risk.

10Limitation of liability

To the fullest extent permitted by law, Varie Industries and its owners, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of, or inability to use, FitCheck. To the extent liability cannot be fully excluded, our total liability for any claim relating to the app is limited to the greater of the amount you paid us for the app in the twelve months before the claim, or twenty-five United States dollars. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

11Indemnity

You agree to indemnify and hold harmless Varie Industries and its owners, employees, and partners from any claims, damages, losses, and reasonable costs, including legal fees, arising from content you add or create in the app, your misuse of the app, your violation of these terms, or your violation of the rights of another person, including any claim that a photo you added was used without the necessary rights or consent.

12Apple and these terms

You download FitCheck from the App Store, and the following applies between you and Apple:

This agreement is between you and Varie Industries only, not with Apple. Apple is not responsible for FitCheck or its content.
Apple has no obligation to provide any maintenance or support for FitCheck.
If FitCheck fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price where applicable. To the maximum extent allowed by law, Apple has no other warranty obligation for the app, and any other claims relating to the app are our responsibility, not Apple's.
Apple is not responsible for addressing any claims by you or a third party relating to the app, including product liability, legal or regulatory claims, or intellectual property claims.
You confirm you are not located in a country subject to a United States government embargo and are not on any United States government restricted-party list.
Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

13Governing law

These terms are governed by the laws of the State of Ohio, United States, without regard to its conflict-of-laws rules. You agree that any dispute not resolved directly with us will be handled in the courts located in the State of Ohio, to the extent permitted by law. Nothing here removes any consumer right you have under the mandatory law of the place where you live.

14Changes to these terms

We may update these terms as the app or the law changes. When we do, we will update the effective date at the top of this page. If a change is significant, we will make reasonable efforts to note it in the app. Your continued use of FitCheck after an update means you accept the revised terms.
